Agreement Between User and Botanika Life
Welcome to www.botanika.life (the “Site”). The Site is owned and operated by Botanika Life, Inc. (“Botanika Life,” “we,” “us,” or “our”).
These Terms of Service (“Terms”) govern your access to and use of the Site, including any purchases made through the Site. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.
Botanika Life operates an informational and e-commerce website offering wellness, personal care, skincare, topical pain relief, sleep, recovery, and related products.
Products available through the Site should be used only as directed and in accordance with their applicable product labeling. Except where expressly indicated on the labeling of an applicable over-the-counter drug product, products sold through the Site are not intended to diagnose, treat, cure, or prevent any disease.

Age Requirements

Botanika Life does not knowingly collect personal information from children under the age of 13. If you are under 18, you may use the Site and purchase products only with the involvement and permission of a parent or legal guardian and where permitted by applicable law.

Payment must be made through the payment methods made available during checkout. Additional terms presented by third-party payment providers may apply.
Shipping
Shipping times displayed on the Site are estimates and are not guaranteed unless expressly stated otherwise.
Botanika Life is not responsible for delays caused by carriers, weather, customs, incorrect shipping information supplied by the customer, or circumstances outside our reasonable control.
Customers are responsible for providing accurate and complete shipping information.
Cancellation/Refund Policy
Orders may be canceled within 24 hours of being placed, provided the order has not yet shipped.
Unopened and unused products may be returned within thirty (30) days of purchase for a full refund. Products that have been opened and are returned within thirty (30) days of purchase are eligible for store credit only.

Third-Party Websites and Services
The Site may contain links to websites, applications, payment providers, social-media platforms, or other services operated by third parties (“Third-Party Services”).

Intellectual Property

Botanika Life grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, lawful, non-commercial use.

You grant Botanika Life a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, and adapt content you voluntarily submit in connection with operating, promoting, and improving Botanika Life and its products, subject to applicable law and our Privacy Policy.
We reserve the right to moderate or remove user content where permitted by law, including content that is unlawful, misleading, abusive, infringing, fraudulent, or otherwise inappropriate.
International Users
The Site is controlled and operated from the United States.
Products, statements, labeling, availability, and regulatory requirements may differ by jurisdiction.
If you access the Site or purchase products from outside the United States, you are responsible for determining whether your access, purchase, possession, importation, and use of the applicable product complies with local laws.
Botanika Life does not represent that every product available on the Site is lawful or available in every jurisdiction.

NOTHING IN THESE TERMS EXCLUDES WARRANTIES, RIGHTS, OR REMEDIES THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BOTANIKA LIFE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE.
NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.
Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Botanika Life and its officers, directors, employees, agents, and affiliates from claims, liabilities, damages, costs, and reasonable attorneys’ fees arising from your unlawful use of the Site, violation of these Terms, or infringement of the rights of another person.
Dispute Resolution and Arbitration
To the extent permitted by applicable law, disputes arising out of or relating to these Terms or your use of the Site that cannot be resolved informally will be resolved through final and binding individual arbitration pursuant to the Federal Arbitration Act and administered by the American Arbitration Association under its applicable rules.
The arbitration will be conducted by a single neutral arbitrator at a mutually agreed location or through remote proceedings where appropriate.
The arbitrator will have authority to determine issues relating to the interpretation and enforceability of this arbitration provision, subject to applicable law.
Nothing in this section prevents either party from seeking relief in a small claims court where the dispute qualifies or seeking appropriate injunctive or equitable relief where permitted by law.
Class Action Waiver
TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND BOTANIKA LIFE AGREE THAT CLAIMS WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN A PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION.
The arbitrator may not consolidate the claims of more than one person or preside over a representative or class proceeding unless required by applicable law or agreed to by the parties.
Termination
Botanika Life reserves the right to suspend or terminate access to the Site when reasonably necessary, including for violations of these Terms, suspected fraud or abuse, security concerns, or violations of applicable law.
Provisions of these Terms that by their nature should survive termination will remain in effect following termination.
Governing Law
To the extent permitted by applicable law, these Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Any dispute not subject to arbitration will be brought in a court of competent jurisdiction as permitted by applicable law.
Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will continue in full force and effect.
Entire Agreement
These Terms, together with any policies or terms expressly incorporated by reference, constitute the agreement between you and Botanika Life regarding your use of the Site and supersede prior communications concerning the subject matter of these Terms.
Changes to These Terms
We may update these Terms periodically to reflect changes to our business, Site, products, practices, or applicable requirements.
The current version will be posted on the Site with an updated “Last Updated” date. Your continued use of the Site following the effective date of updated Terms constitutes acceptance to the extent permitted by applicable law.
